The Prosecutor’s Office has requested the closure of the case against two Barcelona fans accused of directing racist insults at Real Madrid’s Vinicius Jr. during an October 2023 match at Montjuïc Stadium.
Authorities ruled out categorizing the incident as a hate crime or an act of degrading treatment.
According to a statement accessed by EFE, the Barcelona Hate Crimes Prosecutor’s Office determined that there was insufficient evidence to confirm the exact remarks made by the accused fans.
Even if the expressions were offensive, prosecutors argue they do not meet the legal threshold for incitement to hatred, as they did not trigger a widespread reaction from the crowd or lead to a match suspension.
However, the Prosecutor’s Office has recommended that the examining magistrate forward the case to the Office of Equal Treatment and Non-Discrimination to assess whether an administrative sanction should be imposed.
The case originated from a report by the Mossos d’Esquadra, which documented racist chants and insults aimed at Vinicius Jr. during the Barcelona-Real Madrid clash at Montjuïc.
