The complaint against FC Barcelona’s president, Sandro Rosell, in the Neymar transfer case has been deemed admissible by the Spanish courts. However, the urgency to hear Mr. Rosell is considered only when the preliminary investigation is more advanced, according to a judgment published on Wednesday.
A supporter-member of the club accuses Sandro Rosell of “undue appropriation,” an offense similar to abuse of social property in French law. The complainant argues that the club members are unaware of the “real destination” of the 57 million euros paid for Neymar’s transfer, as claimed by Barcelona. Judge Pablo Ruz of the National Court of Madrid finds in his judgment that there are sufficient elements, based on the examination of the complaint’s content and requested documents from FC Barcelona, to accept the complaint.
The judge sends a letter rogatory to Brazil, requesting that the Santos club provide the contract of the 21-year-old player, as well as the transfer contract. Neymar himself is also required to provide “the contract signed with the company N&N in which he transferred ‘future economic rights’.” Additionally, he requests FIFA to send him “the documents it has in its archives concerning the transfer of Neymar Dal Silva Santos Junior.” However, Judge Pablo Ruz believes there is no urgency or necessity to hear Sandro Rosell as an indicted party until the preliminary investigation progresses further.
