Spanish prosecutors seek 10-year prison sentence for Rafa Mir as legal case deepens

Spanish striker Rafa Mir is facing serious legal challenges after Spanish prosecutors requested a prison sentence of ten and a half years over allegations of sexual assault.

The forward, who currently plays for Elche CF, remains under investigation as the case continues to move through the judicial process.

According to the prosecution, the player should receive a nine-year prison sentence for the alleged sexual assault, in addition to an extra eighteen months for physical assault and causing psychological harm to the complainant.

The case reportedly dates back to September 2024, when Mir was accused of raping a woman in her home after a match involving Valencia CF. Reports indicate that the night involved a visit to a nightclub in the city before the incident allegedly occurred, eventually leading the woman to file a formal complaint with the court.

Spanish sports outlet Marca reported that prosecutors are also seeking a restraining order that would prevent Mir from approaching the alleged victim within a distance of 500 metres for a period of 13 years.

In terms of civil liability, prosecutors are demanding that the player pay compensation amounting to 64,000 euros to cover the physical and moral damages allegedly suffered by the victim.

The case also involves another footballer, Pablo Jara, who was reportedly present at Mir’s residence on the night of the incident. The Public Prosecution is requesting a three-year prison sentence for Jara on charges of assaulting a second victim.

For his part, Mir has denied the sexual assault allegations brought against him, insisting that he rejects the accusations while the legal process continues in court.

In a separate development, the striker was recently involved in another controversy during a match between Elche CF and RCD Espanyol in the 26th round of La Liga.

According to Mundo Deportivo, Moroccan international Omar El Hilali approached the referee in the 78th minute to complain about an offensive remark allegedly made by Mir. The newspaper reported that El Hilali informed the referee that the Spanish striker addressed him with the phrase: “I came in a small boat,” a comment considered to carry racist connotations.

The referee subsequently activated the league’s anti racism protocol, leading to a temporary stoppage of the match for several minutes before play resumed. The encounter eventually ended in a 2–2 draw.

In his official match report, the referee noted that in the 78th minute, Espanyol player Omar El Hilali, wearing number 23, informed him that Elche player Rafa Mir, number 10, had directed the remark at him. He added that none of the other match officials heard the statement directly, but he nevertheless implemented the precautionary protocol, which resulted in a three-minute stoppage of play.

Mundo Deportivo further reported that La Liga’s disciplinary committee is expected to review the incident in the coming days.

The outlet noted that the version of events currently available is that of the Moroccan player, while Mir has denied the accusations made against him during the match. A final decision may depend on what television footage from the game ultimately reveals.
